BAY OF ISLANDS YACHT CLUB
RULES AND REGULATIONS
The Bay of Islands Yacht Club welcomes those who will use the facilities and will appreciate any suggestions for the improvement of its facilities and services.
For the purpose of all who use these facilities, the following Rules and Regulations have been established.
SECTION 1
ASSIGNMENT OF DOCKS
1. Dock Assignment will be made by the Harbour Master in consultation with the Executive on or about May 1st. Applicants may request a specific dock but assignments will be made to serve the best use of the facilities. No carry over can be assured.
2. Priority will generally be given holders of same boat/size assignments the previous season. Applicants on the waiting list will then be assigned in accordance with date and size classification.
3. Waiting list applicant who rejects a preferred dock assignment will be allowed to maintain priority on the list for one year. If after one year, the applicant again rejects the preferred dock assignment, the applicant will be removed from the list and the wait list fee refunded. The applicant may reapply as a new applicant at the end of the waiting list.
4. An assigned space holder who sells or loses permanent use of owned craft will have first priority for 30 days during the summer season to meet new boat requirements for the same space.
5. Qualification for dock assignment is achieved only by coming up through the wait list. When the initial dock assignments were made several years ago, seniority was the governing factor.
SECTION 2
HOLDERS OF DOCK ASSIGNMENTS
1. Holders of dock assignments may not transfer use of space. The Harbour Master must be notified by owners of vessels leaving for extended cruises so that space can be rented to transient boaters.
2. Upon the death of an assigned dock holder, an interested legal spouse may retain the dock assignment. In the absence of an interested spouse, a next of kin may continue to keep the boat in the Marina for the balance of the season. The following year, priority for the space will be determined by the standard wait list and dock assignment procedures.
SECTION 3
USE OF DOCKS AND MARINA AREA
1. Summer Season - May 1 to October 31
2, Extended Season- Dock holders wishing to remain in the Marina beyond November 1st will be required to pay for the proportional cost of services provided. Such an arrangement to be worked out in consultation with the Harbour Master. Non Members requesting docking space at the Marina during the Extended Season will be charged the membership equivalent for docking space plus the proportional amount of electricity consumed. Prior approval must first be obtained from the Harbour Master. If approved, dock assignment to be made based on size of boat. Regulations will be maintained while boats remain in the Marina during the extended season. Non Members using the Marina during the extended season will be required to leave not later than the beginning of the recreation boating season May 1st.
SECTION 4
MARINA RULES
The Harbour Master has the authority to enforce the following.
1. All boats shall be operational, properly and safely tied to the dock.
2. Dock Holders may affix rubber, plastic or composite material such as fenders, sock bumpers, molded strips and like materials to docks provided the material effects only the dock holder and does not restrict the free passage along docks. Dock holder must accept responsibility for removing the material if required to do so.
3. Sail boats shall use alternate means of propulsion for operation within the Marina.
4. Living aboard any vessel is prohibited from November 1st to May 1st without permission of the Executive Committee.
5. Professional charter operation will be allowed only at the discretion of the Executive Committee. Price for docking, etc. to be determined by the Executive.
6. Fires, whether for cooking, illumination or heating are prohibited in the dock area.
7. Garbage, refuse or waste shall not be thrown or otherwise disposed of in marina’s waters. All garbage and waste shall be placed in containers supplied for that purpose. All local, provincial and federal water pollution regulations are to be followed.
8. Fishing, cleaning of fish, swimming or diving is prohibited in the Marina area.
9. Rafting of boats is prohibited in the Marina except with the approval of the Harbour Master.
10. Dogs and pet animals are permitted in the Marina only on leash or otherwise confined or retained. Owners or keepers are required to remove the animal’s defecation.
11. Children under 12 years are not permitted in area of the docks unless accompanied by a parent or guardian.
12. Boat owners are permitted to carry out normal maintenance on their boats. Boat owners planning on carrying out extensive maintenance shall first consult with the Harbour Master. The use of electricity must be kept to minimal maintenance work and hook up.
13. The use of skateboards, bicycles and motorcycles on docks is prohibited.
14. Any member occupying berthing or storage space is liable for damages caused any other member’ or guests’ boats or club docks. In this regard, members are encouraged to carry at least $1,000,000.00 in third party liability.
15. Any damages to docks or floats will be the responsibility of the member using the berth unless it can be shown that the member is not responsible.
16. There is a stepping mast on the main dock for the use of members. Use it at your own risk.
17. Because of structural limitations, membership may not be available to large vessels 60 ft. and over. An exception can be made during the off season November 1st to April 30th when a limited number of spaces are available at the Main Dock. (See section above).
18. As soon as possible after launch, storage cradles and trailers shall be moved to the storage area assigned by the House and Grounds Committee.
19. Allocation of storage space and positioning of boats on the main dock during haul up will be under the direction of the Harbour Master. The cooperation of boat owners is very critical in this regard, as the number of vessels requiring storage space is increasing every year.
20. Owners of vessels leaving for an extended period ( in excess of three days) are requested to notify the marina office. The marina reserves the right to rent all slips/spaces when vacant. Transient vessels occupying an absent slip/space are required to move from said slip/space when required.
21. Parking: Parking is available in the marina area. However, members and visitors are advised that parking is not prohibited in the launch ramp area, at the dock entrance gate one and two and immediately in front of club building.
22. Marina Quiet Time: Between the hours of 9 p.m and 7 a.m engines, power generating equipment and other noise making machinery may not be operated in the marina except as necessary to enter or leave the slip. Other noise making equipment shall be operated in compliance with all laws and rules. Please be considerate of others who may be occupying Marina.
